Your privacy rights
Juchepi Group (Pty) Ltd respects the rights of data subjects under the Protection of Personal Information Act 4 of 2013 (“POPIA”) and the Promotion of Access to Information Act 2 of 2000 (“PAIA”).
If Juchepi Group processes personal information about you, you may exercise the rights available to you under applicable law.

What can I request?
Depending on the circumstances and applicable law, you may request or exercise the following rights.
1. Confirmation and access to personal information
You may ask Juchepi Group to confirm whether we hold personal information about you.
You may also request access to personal information or records concerning you, subject to POPIA, PAIA and any lawful grounds on which access may be limited or refused.
Formal requests for access to records are handled through our PAIA & Access to Information process.
2. Correction of personal information
You may request correction of personal information where you believe the information held by Juchepi Group is:
- inaccurate;
- irrelevant;
- excessive;
- out of date;
- incomplete;
- misleading; or
- obtained unlawfully.
The Information Regulator provides POPIA Form 2 for correction and deletion requests.
3. Deletion or destruction
You may request deletion or destruction of personal information where Juchepi Group is no longer authorised to retain it.
A request for deletion does not automatically require Juchepi Group to delete information where retention remains required or permitted by law, contract, legal proceedings, regulatory obligations or another lawful basis.
4. Object to processing
Where POPIA permits objection to processing, you may object on reasonable grounds relating to your particular situation.
The Information Regulator provides POPIA Form 1 – Objection to the Processing of Personal Information for formal objections.
5. Withdraw consent
Where Juchepi Group relies on your consent as the lawful basis for a particular processing activity, you may withdraw that consent.
Withdrawal of consent does not affect processing that was lawful before the consent was withdrawn and does not prevent continued processing where another lawful basis applies.
6. Object to direct marketing
You may object to direct marketing communications from Juchepi Group at any time.
You may:
- use the unsubscribe mechanism contained in an electronic marketing communication;
- contact Juchepi Group at info@juchepigroup.com; or
- submit a formal objection where appropriate.
There is no charge for requesting that direct marketing communications cease.
POPIA restricts unsolicited electronic direct marketing and requires qualifying marketing communications to provide recipients with a practical way to request that the communications stop.

Please clearly state:
- your full name;
- your contact details;
- the nature of your request;
- the personal information concerned;
- sufficient information for us to identify the relevant records or processing activity; and
- where applicable, your reasons for requesting correction, deletion or objecting to processing.
Identity verification
Juchepi Group must take reasonable steps to ensure that personal information is not disclosed, altered or deleted at the request of an unauthorised person.
We may therefore ask you to provide reasonable proof of identity or authority before completing a request.
Only information reasonably necessary to verify the request will be requested.
Requests made on behalf of another person
If you submit a request on behalf of another individual or organisation, we may require evidence showing that you are authorised to act for that person.
What happens after we receive your request?
Juchepi Group will:
- record the request;
- verify the requester where reasonably necessary;
- identify the relevant systems, records or business functions;
- assess the request against POPIA, PAIA and other applicable law;
- take the appropriate action where the request is valid; and
- communicate the outcome to the requester.
Some requests may require additional information before they can be processed.
Where a formal PAIA request is made, the statutory PAIA procedure and applicable time periods will apply. The Information Regulator’s PAIA Guide records the ordinary decision period as 30 days, subject to the circumstances and permitted extensions.
When a request may be refused or limited
A privacy request does not automatically override other legal obligations.
Juchepi Group may lawfully retain or withhold information where, for example:
- retention is required by law;
- information is required for contractual, tax, accounting or regulatory purposes;
- information is required for the establishment, exercise or defence of legal claims;
- disclosure would unlawfully affect another person’s rights;
- a PAIA ground for refusal applies; or
- another lawful ground permits or requires continued processing.
Where appropriate, Juchepi Group will explain the basis for its decision.

Complaints
If you believe Juchepi Group has unlawfully processed your personal information, you may raise the matter with our Information Officer first.
You also have the right to lodge a complaint with the Information Regulator (South Africa).
