About PAIA

The Promotion of Access to Information Act 2 of 2000 (“PAIA”) gives effect to the constitutional right of access to information and provides procedures through which a person may request access to records held by public and private bodies.

Juchepi Group (Pty) Ltd is a private body for purposes of PAIA and maintains a PAIA Manual prepared in accordance with section 51 of PAIA. The current Manual is available for download through this page.

The Information Regulator requires private bodies to make their PAIA Manuals publicly available, including through their websites and at their principal place of business.

PAIA Manual

Juchepi Group’s PAIA Manual describes:

• the categories of records held by Juchepi Group;
• records that may be available without a formal PAIA request;
• legislation under which Juchepi Group may hold records;
• the procedure for requesting access to a record;
• applicable grounds on which access may be refused;
• fees that may apply under PAIA;
• the processing of personal information under POPIA;
• categories of data subjects and personal information processed;
• recipients of personal information;
• possible cross-border transfers;
• information-security safeguards; and
• the remedies available where a request is refused.

The Manual is prepared under section 51 of PAIA using the Information Regulator’s private-body framework.

How to request access to a record

A person requesting access to a record held by Juchepi Group must submit the prescribed Form 2 – Request for Access to Record and provide sufficient information for Juchepi Group to identify:

• the requester;
• the record requested;
• the form in which access is required;
• the requester’s contact details; and
• where applicable, the right the requester seeks to exercise or protect.

The Information Regulator currently publishes Form 2 as the prescribed access-request form.

Receipt of a PAIA request does not automatically mean that access must be granted. Each request will be considered in accordance with PAIA, including any applicable mandatory or discretionary grounds for refusing access.

Fees

PAIA permits prescribed fees to apply to certain requests and to the reproduction or provision of records.

Where a fee is lawfully payable, the requester will be notified in accordance with PAIA before the relevant access is provided.

Personal information requests

Requests specifically concerning your own personal information may also be governed by the Protection of Personal Information Act 4 of 2013 (“POPIA”).

Complaints and further assistance

The Information Regulator (South Africa) provides guidance, prescribed PAIA forms and complaint mechanisms.

The Regulator currently provides:
